Terms of Service

These Terms of Service ("Terms") govern your access to and use of MindMaps ("we," "us," or "our"), accessible at mindmapsapp.com (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About MindMaps

MindMaps is an AI-powered educational tool that converts lecture slides and study materials into interactive knowledge maps. The Service is intended for personal, non-commercial educational use only.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at mindmapshq@gmail.com of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Upload, submit, or share any content that infringes the intellectual property rights of any third party
  • Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
  • Use the Service for any commercial purpose, including but not limited to selling, licensing, or monetizing maps or content generated through the Service
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code, algorithms, or underlying systems of the Service
  • Use automated tools, bots, scrapers, or any other means to systematically collect, copy, reproduce, or extract maps, content, or data from the Service for any purpose
  • Reproduce, distribute, modify, or create derivative works from any part of the Service without our express written permission
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the integrity or performance of the Service

5. Intellectual Property

The Service, including its design, source code, algorithms, AI systems, visual elements, user interface, and all content produced by MindMaps (excluding User Content as defined below), is owned exclusively by MindMaps and is protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

You acknowledge and agree that:

  • MindMaps retains all rights, title, and interest in the platform, including the AI systems, algorithms, and processes used to generate knowledge maps
  • The visual structure, layout, organization, and presentation of generated maps are proprietary to MindMaps
  • Nothing in these Terms transfers any ownership of MindMaps intellectual property to you
  • You may not copy, modify, reproduce, distribute, reverse engineer, or create derivative works from any part of the Service

The MindMaps name, logo, and product names are trademarks of MindMaps. You may not use these marks without our prior written consent.

6. Content You Upload

You retain ownership of the content you upload to MindMaps, including lecture slides and study materials ("User Content"). By uploading User Content, you grant MindMaps a limited, non-exclusive, royalty-free license to process, store, and display your content solely for the purpose of providing the Service to you.

You represent and warrant that:

  • You own the content you upload or have the necessary rights and permissions to upload it
  • Your content does not infringe the copyright, trademark, or other intellectual property rights of any third party
  • Your content does not violate any applicable law or regulation

We do not claim ownership of your User Content.

7. Maps and Generated Content

Knowledge maps generated by MindMaps using your uploaded content are derived works created by our AI systems based on your User Content. You may use these maps for personal, non-commercial educational purposes only. You may not use maps or any AI-generated content from the Service for commercial purposes, including resale, distribution for profit, or incorporation into commercial products.

MindMaps retains all rights in the AI systems, algorithms, and processes that generate knowledge maps. The fact that a map is derived from your User Content does not transfer ownership of the underlying platform or generation systems to you.

Public maps you choose to share are visible to all users of the Service. You are solely responsible for any content you make public.

8. Credits and Subscriptions

MindMaps offers free and paid subscription tiers. Credits are consumed when you upload lecture slides for processing. Credits are non-transferable and non-refundable except as required by applicable law.

Paid subscriptions are billed on a recurring basis. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

We reserve the right to modify pricing at any time with reasonable notice to subscribers.

9. DMCA and Copyright Policy

MindMaps respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). We have registered a DMCA agent with the U.S. Copyright Office.

If you believe content on the Service infringes your copyright, please send a written notice to:

Your notice must include:

  • Identification of the copyrighted work you claim has been infringed
  • Identification of the material you claim is infringing and its location on the Service
  • Your contact information (name, address, phone number, email)
  • A statement that you have a good faith belief the use is not authorized by the copyright owner
  • A statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf
  • Your physical or electronic signature

We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing content.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT OR MAPS GENERATED BY THE SERVICE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MINDMAPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless MindMaps and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in New York, and you consent to personal jurisdiction in those courts.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
